Ezine The Celotex Asbestos Settlement Trust Fund

On theĀ 1st. of February in 1998, the Celotex Asbestos Trust was installed as a direct result of the bankruptcy declaration of the Celotex Corporation and Carey Canada. The Delaware based Celotex Corporation was founded in ’64. The company became a leader in the manufacture and distribution of roofing and building supply products, which were widely used in residential and commercial structures nationwide. Carey Canada, a subsidiary of Celotex, mined and processed asbestos for its owner.

We known that exposure to asbestos is the cause for numerous devastating diseases, inducing lung cancer, asbestosis and mesothelioma. Those conditions are responsible for thousands of newly diagnosed patients and unfortunately, even deaths among those who had been diagnosed already. Asbestos induced diseases are known for their long latency period which makes early detection practically impossible and therefore the prognosis rather poor.

The installation of the Celotex Asbestos Trust Fund was a legal consequence of the bankruptcy Celotex and Carey Canada had to file on October 12, 1990. The trust fund has a clearly defined purpose: review all valid asbestos personal injury claims, process them timely and issue compensation payments to the claimants after approval.

If a person was employed by Celotex, Carey Canada or any predecessor company of either entity, and has evidentially developed a disease caused by the exposure to asbestos during the time he was employed by any or the aforementioned parties, he is eligible for filing a personal injury claim with the trust. In addition to that, if an individual didn’t get sick yet, but has reason to believe that he will, he still may file a claim. Also anybody who is generally uncertain of their potential eligibility may go ahead and file their case.

Each claim will be reviewed, evaluated and decided internally. If it is found to be valid and therefore receives approval, you will be getting an offer. If you decide to accept the offer, a check will be issued to you within a matter of a few months. A seemingly straight forward process indeed, however, you still may retain a specialized personal injury attorney to ensure speedy and flawless processing of your claim.
